Terms of Service

1. Eligibility

You must be at least 13 years of age (or the equivalent minimum age in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Description of the Service

PitchCut is a software service that allows you to upload images and provide a textual description in order to generate a short promotional video as an output file. The Service is provided on a limited free basis. Features, limits, and availability of the Service may change at our discretion.

3. No Account Required

The Service does not require account creation. Free use is limited per browser by a usage counter stored in your browser’s local data, as described in our Privacy Policy. We reserve the right to introduce paid plans, accounts, or different usage limits in the future. Such changes will not retroactively revoke videos already generated.

4. User Content and Responsibilities

“User Content” means any content you submit to the Service, including images and descriptions. You retain all ownership rights in your User Content. You grant us a limited, non-exclusive, royalty-free license to use, process, transmit, and display User Content solely for the purpose of operating the Service and providing the video output to you. This license terminates when we delete the User Content from our systems following completion of the requested rendering, as described in our Privacy Policy.

You are solely responsible for the User Content you submit. By submitting User Content, you represent and warrant that:

• You own or have all necessary rights, licenses, consents, and permissions to submit the User Content and to grant the license described above.
• The User Content does not infringe or violate the intellectual property, privacy, publicity, or other rights of any third party.
• The User Content does not contain unlawful, defamatory, obscene, harassing, or otherwise objectionable material.
• The User Content does not contain personally identifying information of any third party submitted without that party’s consent.

5. Generated Output

Subject to your compliance with these Terms, you own the video files generated by the Service from your User Content (“Output”) and are free to use the Output for any lawful purpose, including commercial use, without attribution. We make no claim to ownership of Output. We provide no warranty regarding the quality, accuracy, or fitness for any particular purpose of the Output.

6. Prohibited Uses

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party right;
• Submit content you do not have the right to use;
• Generate content that is unlawful, defamatory, harassing, threatening, hateful, sexually explicit, or that incites violence;
• Impersonate any person or misrepresent your affiliation with any entity;
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its underlying systems, including by automated means, scraping, or bypassing usage limits;
• Use the Service to develop a competing product or to train machine-learning models;
• Resell, redistribute, or sublicense access to the Service.

We may suspend or terminate access to the Service at our sole discretion if we reasonably believe you have violated these Terms.

7. Our Intellectual Property

The Service, including its software, design, trademarks, and all related intellectual property (excluding User Content and Output), is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any right, title, or interest in or to the Service except for the limited right to use the Service as expressly permitted herein.

8. Availability and Modifications

The Service is provided on an “as is” and “as available” basis. We do not warrant that the Service will be uninterrupted, error-free, or available at any particular time. We may modify, suspend, or discontinue the Service, in whole or in part, at any time without notice or liability.

9. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE OR OUTPUT WILL MEET YOUR REQUIREMENTS OR THAT THE SERVICE WILL BE SECURE, ACCURATE, UNINTERRUPTED, OR FREE OF DEFECTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED ONE HUNDRED INDIAN RUPEES (₹100) OR THE EQUIVALENT IN ANOTHER CURRENCY.

11. Indemnification

You agree to defend, indemnify, and hold harmless PitchCut and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice or cause. Upon termination, the provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in India.

14. Changes to These Terms

We may revise these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Material changes will be highlighted on this page. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
